Welcome to www.shybunny.ca (the “Website”), owned and operated by 16008020 Canada Inc., operating as Shy Bunny (“Shy Bunny,” “we,” “us,” or “our”). Except as otherwise noted herein, these Terms of Service (the “Terms”) govern your access to and use of the Website, Shy Bunny’s services, applications, and content (collectively, the “Site”), and your purchase, receipt, or use of Shy Bunny cosmetics and other products made available through the Site (collectively, the “Products”).
PLEASE READ THESE TERMS CAREFULLY. YOUR ACCESS TO OR USE OF THE SITE, OR YOUR PURCHASE, RECEIPT, OR USE OF PRODUCTS, CONSTITUTES YOUR AGREEMENT TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE THE SITE OR PURCHASE, RECEIVE, OR USE OUR PRODUCTS.
These Terms contain a mandatory arbitration provision and a class action waiver that, except where prohibited by law, require the use of arbitration on an individual basis to resolve disputes, rather than jury trials or class actions.
Shy Bunny reserves the right to update, change, or modify these Terms at any time and in our sole discretion. If we make material changes, we will notify you by posting revised Terms on the Site and/or by sending notice via email. By continuing to access or use the Site or purchase, receive, or use Products after notice of changes has been provided, you confirm your acceptance of the revised Terms and all incorporated terms.
Account Creation and Eligibility
To purchase Products or use certain features, you may be required to create a Shy Bunny account. You must provide accurate and complete information, including your name, email address, and payment details. You agree to maintain the accuracy of this information and promptly update any changes.
You must be at least 13 years of age to use the Site. If you are under the age of majority in your province or territory of residence, you may only use the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
You agree to safeguard your username and password and not to share them with any third party. You are solely responsible for all activity under your account and for maintaining the confidentiality of your credentials. You agree to notify Shy Bunny immediately if you become aware of unauthorized access to your account.
You may not create more than one account, nor may you use another person’s account. Shy Bunny reserves the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or conduct detrimental to Shy Bunny.
Orders, Pricing, and Payments
All Product prices are displayed in Canadian dollars (CAD) unless otherwise stated. Taxes and shipping fees will be added at checkout. Payment must be made in full prior to shipment.
Shy Bunny strives to ensure accurate Product information, descriptions, and pricing; however, errors, inaccuracies, or omissions may occur. We reserve the right to correct errors, change pricing, and update Product information without notice. If an error affects your order, we may cancel or adjust your order and will notify you accordingly.
Colors of Products displayed on the Site may vary depending on your device’s display. We cannot guarantee that your monitor will accurately portray the actual colors.
Your order is not binding until we send an order confirmation. We reserve the right to cancel any order at our discretion, including but not limited to suspected fraudulent activity, errors in Product information, or prohibited resale activity.
Quantity Limitations and Resale Restrictions
We may, at our sole discretion, limit the quantity of Products purchased per person, per household, or per order. Orders that appear to be placed by dealers, resellers, or distributors may be refused or cancelled. Products purchased are for personal, non-commercial use only and may not be resold, exported, or redistributed.
Shipping and Delivery
Currently, Shy Bunny ships Products only within Canada. Orders will be shipped to the address provided at checkout. Risk of loss and title to Products pass to you upon transfer of the Products to the shipping carrier.
Delivery dates provided are estimates only and not guaranteed. Shy Bunny is not responsible for delays caused by carriers, weather, or other factors beyond our control.
We reserve the right to charge additional shipping fees or adjust shipping methods at any time, with notice provided at checkout.
Taxes
We will collect applicable sales tax on Products shipped within Canada where we are legally required to do so. The amount of tax charged will depend on the province or territory to which the Products are shipped. If tax rates change, the amount charged at checkout may be adjusted.
Returns and Exchanges
Due to the nature of cosmetic products, all sales are generally final. In cases where a return or exchange is permitted under our Return Policy or required by applicable law, Products must be returned in unopened and unused condition, with original packaging, within the specified return period. Shipping fees are non-refundable unless otherwise stated.
Product Disclaimer and Medical Waiver
Our Products are for cosmetic use only. They are not intended to diagnose, treat, cure, or prevent any medical condition. The Site is not a substitute for professional medical advice. Always read Product labels and ingredient lists before use. If you experience an adverse reaction, discontinue use immediately and consult a physician.
Shy Bunny does not represent itself as a medical provider and does not offer medical advice. If you have concerns about Product use, consult your healthcare professional.
User Content and Social Media
You may post reviews, comments, photos, videos, or other content on the Site or social media platforms (collectively, “User Content”). By posting User Content, including tagging Shy Bunny with hashtags such as #ShyBunnyDiaries, etc. you grant Shy Bunny a perpetual, worldwide, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, modify, publish, display, and create derivative works from such User Content in any media, for any purpose, including marketing, advertising, and promotional activities.
You represent and warrant that: (i) you own or have rights to your User Content, (ii) you have obtained necessary permissions for individuals appearing in your User Content, and (iii) your User Content does not violate any law or third-party rights.
Shy Bunny may, at its sole discretion, remove or refuse to display any User Content.
Prohibited Conduct and Security
You agree not to:

Access the Site in any unauthorized manner, including hacking or bypassing security controls.

Post or transmit material that is unlawful, defamatory, obscene, offensive, infringing, or otherwise objectionable.

Upload viruses, malware, worms, Trojan horses, or harmful code.

Attempt to interfere with the Site’s operation, including denial-of-service attacks, overloading, or spamming.

Scrape, harvest, or extract data from the Site for commercial purposes, including for machine learning or AI training, without our express written consent.

Use the Site in violation of any applicable Canadian or international laws.
Violations may result in suspension, termination, civil liability, or referral to law enforcement.
Intellectual Property
All content on the Site, including text, graphics, logos, images, Product packaging, design, code, and software (the “Materials”), is the property of Shy Bunny or its licensors and is protected by Canadian and international copyright, trademark, and intellectual property laws.
“Shy Bunny” and related logos, designs, and marks are trademarks owned by Shy Bunny. You may not use them without prior written consent.
Except as expressly authorized, you may not copy, reproduce, distribute, modify, or create derivative works from any Materials.
Promotions, Contests, and SMS
Shy Bunny may from time to time offer promotions, sweepstakes, or contests. Participation is voluntary and subject to additional terms and rules.
We may also offer SMS or MMS mobile messaging programs. By opting in, you consent to receive marketing and transactional messages at the phone number you provide. Message and data rates may apply. You may opt out by replying “STOP” to any message, or seek assistance by replying “HELP.” Delivery of messages may depend on your carrier and service provider; Shy Bunny is not responsible for delayed or undelivered messages.
Third-Party Links
The Site may contain links to third-party websites, applications, or services. Shy Bunny does not endorse or control these third parties and is not responsible for their content, terms, or privacy policies. Accessing third-party sites is at your own risk.
Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Shy Bunny, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from: (i) your use of the Site or Products, (ii) your violation of these Terms, (iii) your User Content, or (iv) your infringement of any third-party rights.
Disclaimers
The Site and Products are provided “as is” and “as available.” Shy Bunny disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that the Site will be uninterrupted, error-free, or secure, or that Products will meet your expectations.
Limitation of Liability
To the fullest extent permitted by law, Shy Bunny and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or Products, even if advised of the possibility of such damages.
In no event shall Shy Bunny’s total liability exceed the greater of CAD $100 or the amount paid by you for the Product at issue.
Some provinces may not allow the exclusion or limitation of liability; in such cases, certain limitations may not apply.
Governing Law and Dispute Resolution
These Terms and any disputes arising out of or related to them are governed by the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict of laws principles.
Except where prohibited by law, any dispute, claim, or controversy shall be resolved exclusively by binding arbitration in Toronto, Ontario, administered in accordance with Canadian arbitration rules. You agree to arbitration on an individual basis; class actions and representative proceedings are not permitted.
If arbitration is not enforceable, disputes shall be resolved in the courts of Ontario, and you submit to the exclusive jurisdiction of such courts.
Termination
Shy Bunny may terminate or suspend your access to the Site at any time, with or without cause, and without notice. Upon termination, all provisions of these Terms which by their nature should survive shall remain in effect.
Modifications
We may revise these Terms at any time. Updated Terms will be posted on the Site with the “Last Updated” date. Continued use of the Site constitutes acceptance of the revised Terms.
Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Shy Bunny regarding your use of the Site and Products, and supersede all prior agreements.
Language
It is the express wish of the parties that these Terms and all related documents be drafted in English only.
